457 VISA – Temporary Work (Skilled)
The Temporary Work (Skilled) (Subclass 457) visa is for skilled workers from outside Australia who have been sponsored and nominated by a business to work in Australia on a temporary basis (between three months and four years).
Employer sponsorship occurs when a business wants an appropriately skilled person from overseas to fill a position and allows skilled migration to Australia. The position to be filled must appear on the Consolidated Sponsored Occupations List.
As part of this visa process, employees may bring any eligible family members to Australia. In general those family members will have unrestricted work and study rights.
Whilst under a 457 visa, an employee can only work for his or her sponsor and cannot volunteer for any other organisation. Minimum qualification levels must in some cases also be met for skills such as English language skills and there are health and character requirements too.
There are three stages to a 457 visa application – the business/employer must apply to be a sponsor and it must nominate a position. The employee also has to apply for the visa. All of these applications can be submitted at the same time.
